1. INTRODUCTION

These conditions of use (the "Licence") apply to the computer program known as "!SICK" (the "Program"). The Program is a copyrighted work whose copyright is held by Matthias Seifert (the "Author"). The Author grants to the possessor of this copy (the "Licensee") certain limited rights to use the Program. All rights not specifically granted in this Licence are reserved to the Author.

By installing, copying, or otherwise using the Program, the Licensee agrees to be bound by all of the terms and conditions of the Licence. If the Licensee does not agree to the terms of this agreement the Licensee must not install, use, copy or distribute the Program and must delete the Program immediately.


2. DISCLAIMER

The Program is provided by the Author "as is" and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall the Author be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this Program, even if advised of the possibility of such damage.


3. LICENCE GRANT

The Author grants the Licensee a royalty-free, non-exclusive licence to use the Program. The Licensee may copy and distribute the Program without charging for a fee, provided that all parts of this Program (including, but not limited to, the above copyright notice and this Licence) appear unchanged in all copies made of the Program.


4. RESTRICTIONS

Except as otherwise expressly permitted in this Agreement, or in a written case-by-case agreement between the Author and the Licensee, the Licensee may not:

a) distribute the Program to any third party if any payment is made in
   connection with such distribution, whether directly or indirectly, including,
   but not limited to, payment for a copy of the Program, payment for some
   service related to the Program, or payment for some product or service that
   includes a copy of the Program.

b) make the Program available for download.

c) modify or create any derivative works of the Program or documentation,
   including translation or localization.

d) decompile, disassemble, reverse engineer, or otherwise attempt to derive the
   source code for the Program.

e) make commercial use of the Program, including, but not limited to,
   developing other products by the help of the Program, or providing a
   commercial service which involves the use of the Program.


5. TERMINATION

Without prejudice to any other rights, the Author may, at his sole discretion, terminate this Licence at any time. Upon termination, the Licensee shall destroy all copies of the Program.


6. PROPRIETARY RIGHTS

Title, ownership rights, and intellectual property rights in the Program shall remain in the Author. The Licensee acknowledges such ownership and intellectual property rights and will not take any action to jeopardize, limit or interfere in any manner with Author's ownership of or rights with respect to the Program.


7. GENERAL

This Licence shall be considered as a contract made in Germany and subject to German law and to the exclusive jurisdiction of the German courts. If for any reason a court of competent jurisdiction finds any provision of this Licence, or portion thereof, to be unenforceable, that provision of the Licence shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this Licence shall continue in full force and effect.
